This Privacy Notice (DISCLAIMER) establishes the terms and conditions under which WORLDWIDE LOGISTICS FORWARDING SERVICES, S.A. DE C.V., hereinafter WWL, with address located at: Avenida Insurgentes Sur No. 826, Ala 8 Sur, Colonia Del Valle Centro, C.P. 03100, Alcaldía Benito Juárez, CDMX, Mexico, will process the personal data of the Owner, in compliance with the Federal Law on the Protection of Personal Data in Possession of Private Parties (“the Law”), and its regulations, informing you that:

WWL protects and safeguards your personal data to prevent damage, distribution, marketing, loss, destruction, theft, misplacement, alteration, as well as unauthorized processing.

 What Information Do We Collect?

The personal data that you provide to WWL, through the use of our services, in person, in writing, by email or by any digital means and/or by telephone includes: (i) personal information and documentation, (ii) identity data, (iii) employment information and documentation, in the case of workers or applicants for a position, (iv) financial information and documentation,  (iv) tax information and documentation, (v) legal information and documentation, (vi) information on goods to be transported, (vii) destination and origin of the goods to be transported, (viii) information on the personnel authorized for the delivery and reception, at origin and final destination of the goods, such as: schedules, position, name.

To ensure that the personal data provided is correct and current, WWL may collect information from other sources such as personal, work and/or business references.

WWL may also  request a copy of your official photo ID, credentials issued by federal, state and/or municipal authorities, by decentralized or decentralized bodies and even parastatals, proof of address, notarial testimonies such as powers of attorney, articles of incorporation and their amendments, certified copies issued by notaries, public brokers or by jurisdictional and non-jurisdictional authorities in exercise of its powers, Unique Population Registry Code (CURP), financial data, information on the merchandise subject to transportation, tax returns, Tax Identification Card (RFC), contracts, certificates of registration in private and/or governmental registries, articles of incorporation and protocolized acts, the latter two only in the case of being a legal entity, as well as the signing of credit instruments,  such as promissory notes.

The processing of personal data of third parties that you provide to us is done in accordance with the terms and conditions contained in this Privacy Notice.

Only in the case of applicants for employees may also request sensitive, academic and work data that will be communicated to you in a timely manner, and we will request your consent for the processing based on the applicable legislation.

You consent to the processing of your personal data in accordance with the terms and conditions of this Privacy Notice.

Only in the event that the activity to be carried out is considered by the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin as a vulnerable activity, in addition to the documents indicated above, identification data will also be requested in order to verify your identity and, where appropriate, that of third parties who are beneficiaries of the final product and/or service.  as well as information about their activity or occupation,

based on the notices of registration and updating of activities presented for purposes of the Federal Taxpayer Registry; information with which the Notices, Reports and Documents regulated in the legislation will be presented to the Ministry of Finance and Public Credit, in order to comply with them.

Such information shall be safeguarded, stored and safeguarded in accordance with the provisions of the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin.

In the event of refusal to provide the information and/or documentation required by WWL, it will abstain, without any responsibility, from carrying out the act or operation in question.

The presentation to the Ministry of Finance and Public Credit of Notices, information and documentation referred to in the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin, by WWL in relation to its customers, users or beneficiaries of the products and/or services provided to those who carry out Vulnerable Activities,  it shall not imply any violation of the obligations of confidentiality or legal, professional, fiscal, banking, fiduciary or any other secrecy provided for by law, nor may it be subject to a confidentiality clause in any agreement, contract or legal act. The information and supporting documentation of the Notices, as well as the identity of those who have submitted them, are considered confidential and confidential.

What do we use your information for?

The personal data we collect is intended for: i) Compliance with the obligations originated and/or derived from any legal and/or commercial relationship that we establish due to the provision of our services required by you, ii) To respond to requests in which you show interest about our services, iii) To provide you with advice on logistical matters,  transportation, customs and any other type related to the provision of our services that you request, iv) Inform about our current services, their changes and updates, v) Evaluate the quality of the service, (vi) identify history of service provision, (vii) contact and customer service viii) Verify the information you provide us, ix) Comply with obligations contracted with you,  x) Invoicing and collection for our services, or if applicable, for xi) Include our personnel selection and recruitment processes, xii) Integrate your process in case of being hired, xiii) Include you in our database of electronic records for future vacancies, xiv) Know your profile as a candidate, xv) Integrate your file in case you are hired and xvi) change or cancel the services requested by the Owner.

In the exclusive case of applicants to employees, we process your data in order to carry out the process of recruitment, selection and, where appropriate, hiring.

In the collection and processing of personal data, we comply with all the principles stipulated in the Law and its Regulations: legality, quality, consent, information, purpose, loyalty, proportionality and responsibility.

Who do we share your information with?

WWL may transfer your personal data to national or foreign third parties such as our staff, with whom the privacy policy is replicated and a confidentiality agreement is signed, and may also be shared with consultants, national or foreign, economic, legal, accounting and tax, suppliers in terms of promotion and marketing of our products and services; at the request of an authority; and for compliance with obligations arising from a legal relationship between the owner of the personal data and WWL.

In this sense, WWL may hire one or more third parties as selected service providers to support the activities of economic, legal, accounting and tax consulting, promotion and marketing of our services, management and administration of personal data that is collected through electronic means, or by any other means, as well as for the purposes of verification of the information you provide to us,  so WWL could even refer them to said third party(s) only to comply with the provision of the contracted services. Any third party to whom the aforementioned transfer is made, where applicable, previously states that they are aware of this Privacy Notice and are bound by its terms. Likewise, the recipients of the personal data are obliged by virtue of the corresponding contract, to maintain the confidentiality of the personal data provided by WWL and to observe this Notice.

It is understood that you have given your consent to the transfer of your personal data, if you do not object to them being transferred.

The personal data you provide to WWL may be compiled and stored in a database that is wholly owned by WWL.

What security and control measures do we use to protect your personal data?

WWL implements administrative, technical and physical security measures to protect your personal data, which we require to be complied with by the service providers we hire, including our workforce.

All information and personal data that you provide to us through the use of our services, in writing, mail or any electronic means and/or by telephone, will constitute a database owned by WWL. The information is stored for protection purposes, to prevent loss, misuse, disclosure, marketing or alteration.

Protecting the privacy of children’s personal data is especially important to WWL. For this reason, when we become aware of the personal data of minors, their processing will be carried out in compliance at all times with the guidelines and requirements established in the Law and its Regulations.

In the event of a breach of our means and/or security measures, WWL will immediately inform the data subject so that the necessary measures can be taken.

How can you limit the use or disclosure of your personal data?

You can contact WWL in the event that you wish to limit the use or disclosure of your personal data to stop receiving any type of information such as: advertising of services, status of your procedures or status of the provision of our services, by sending a free letter, with the minimum characteristics indicated immediately below, to the “Data Privacy” area, through the email account

WWL will keep the owner’s personal data for as long as necessary to process their requests for information, products and/or services, as well as to maintain accounting, legal, financial and audit records in terms of the Law and its regulations, as well as the commercial, tax and administrative legislation in force and applicable.

How can you exercise your ARCO rights and revoke the consent granted?

As the owner of personal data, you may exercise the ARCO Rights (access, cancellation, rectification and opposition to the processing of personal data), or revoke the consent you have granted to WWL for the processing of your personal data, by sending your request in writing, directly to the “Data Privacy” area, through the email account ,  with the subject “Data Privacy”; by going personally to our offices; or, requesting it in writing, sending it to the address located at: Avenida Insurgentes Sur No. 826, Ala 8 Sur, Colonia Del Valle Centro, C.P. 03100, Alcaldía Benito Juárez, CDMX, Mexico. Such request, in writing, must contain at least (1) your name, (2) your full address and email address that authorizes you to receive the information you require and the corresponding notifications, (3) documents that prove your identity, clearly indicating the link of the relationship with WWL, (4) specify clearly and precisely the personal data for which you request access,  rectification, updating or cancellation, (5) the elements or documents in which the personal data may be stored and (6) indicating the reasons why you wish to access your personal data, or the reasons why you consider that your data should be updated, rectified or cancelled.

From the time of receipt, the Data Privacy area will have a period of 15 business days to respond to your request, however, this period may be extended for an equal period of time, which will be notified to you by the means that you have indicated for such purposes, indicating the reasons for such extension.  in accordance with Article 32 of the Law.

Likewise, we inform you that, in terms of the Law and its regulations, as of January 6, 2012, you may initiate the ARCO Rights Protection procedure, before the Federal Institute for Access to Information and Protection of Personal Data (IFAI), within 15 days following the date on which WWL responds to your request and it is not satisfactory.  or, if after the indicated period, WWL does not respond to its request.

In the case of WWL workers, their information and documentation will be safeguarded in accordance with the applicable regulations so, derived from the provisions of various regulations, initially by the Federal Law on the Protection of Personal Data in Possession of Private Parties (LFPDPPP), as well as the Federal Labor Law (LFT), Social Security Law (LSS) and Federal Tax Code (CFF),  as well as its Regulations, we are obliged to safeguard said documentation by a

period of five years, once the relationship ends, since the Law states that the personal data that are adequate, relevant and strictly necessary for the purpose that justifies their processing must be processed and, once these have ceased to be necessary for the fulfilment of the purposes, they must be deleted – after blocking where appropriate – when their retention period expires. On the other hand, the LFT requires us to keep documents related to an employment relationship for a period of two years. The LSS indicates that employers are obliged to “keep records, such as payslips and line lists in which the number of days worked and the wages received by their workers are invariably recorded.” These records must be kept for five years following their date. As well as the CFF and its Regulations, for tax purposes, the documentation and information related to compliance with tax provisions must be integrated, including that related to the hiring of individuals who provide subordinate personal services, as well as that relating to their registration and registration, or notices made in matters of social security and their contributions for a period of five years.

Therefore, in compliance with the aforementioned legal regulations, the labor files will be safeguarded for a period of five years, once the contractual relationship has ended, in strict adherence to the regulations in force.

Consent to the processing of personal data
